Terms of Service

Article 1 (Purpose)

These Terms and Conditions set forth the rights, obligations, and responsibilities of the Cyber Mall and users in connection with the use of internet-related services (the "Services") provided by the fitsuit site (the "Mall") operated by GOLD FINGER Co., Ltd. (the "Company"), an e-commerce business operator.

※ These Terms shall also apply to electronic commerce using PC communications and wireless communications to the extent that it is not contrary to its nature.

Article 2 (Definitions)

① "Mall" means a virtual place of business established by the Company using information and communications facilities such as computers to provide goods or services (the "Goods, etc.") to users and to enable transactions of such Goods, etc., and also refers to the business operator that operates the Cyber Mall.

② "User" means a member or non-member who accesses the "Mall" and receives the Services provided by the "Mall" under these Terms.

③ "Member" means a person who has registered as a member of the "Mall" and can continuously use the Services provided by the "Mall."

④ "Non-member" means a person who uses the Services provided by the "Mall" without registering as a member.

Article 3 (Display, Explanation and Amendment of Terms)

① The "Mall" shall post the contents of these Terms, its trade name and representative's name, business address (including the address for handling consumer complaints), telephone number, fax number, email address, business registration number, mail-order business registration number, and the person in charge of personal information management so that users can easily know them on the initial service screen (front page) of the "Mall." However, the contents of the Terms may be made available to users through a linked screen.

② The "Mall" shall, prior to the user's agreement to these Terms, provide a separate linked screen or pop-up screen so that the user can understand important content such as withdrawal of subscription, delivery responsibility, refund conditions, etc., and obtain the user's confirmation.

③ The "Mall" may amend these Terms within the scope not violating the relevant laws, including the Act on Consumer Protection in Electronic Commerce, etc., the Act on the Regulation of Terms and Conditions, the Framework Act on Electronic Documents and Transactions, the Electronic Financial Transactions Act, the Electronic Signature Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., the Door-to-Door Sales Act, and the Framework Act on Consumers.

④ If the "Mall" amends these Terms, it shall specify the effective date and reason for amendment and post them on the initial screen of the "Mall" together with the current Terms from 7 days before the effective date until the day before the effective date. If the amendment is disadvantageous to users, the "Mall" shall provide a prior notice period of at least 30 days. In such cases, the "Mall" shall clearly compare the contents before and after the amendment so that users can easily understand them.

⑤ If the "Mall" amends these Terms, the amended Terms shall apply only to contracts concluded after the effective date, and the provisions of the Terms before amendment shall apply to contracts already concluded before that date. However, if a user who has already entered into a contract expresses an intent to be subject to the amended Terms within the notice period and obtains the "Mall's" consent, the amended Terms shall apply.

⑥ Matters not specified in these Terms and the interpretation of these Terms shall be governed by the Act on Consumer Protection in Electronic Commerce, etc., the Act on the Regulation of Terms and Conditions, the Consumer Protection Guidelines in Electronic Commerce, etc. prescribed by the Fair Trade Commission, and relevant laws or customary practices.

Article 4 (Provision and Change of Services)

① The "Mall" performs the following tasks.

1. Providing information on Goods or Services and concluding purchase contracts

2. Delivering Goods or Services for which purchase contracts have been concluded

3. Other tasks determined by the "Mall"

② The "Mall" may change the contents of Goods or Services to be provided under future contracts in the event of out-of-stock or changes in technical specifications, etc. In such cases, the "Mall" shall immediately post the changed contents and the date of provision in the place where the current contents are posted.

③ If the "Mall" changes the contents of the Services agreed with the user due to out-of-stock or changes in technical specifications, etc., it shall immediately notify the user of the reason at the address where the user can be contacted.

④ In the preceding case, the "Mall" shall compensate the user for any damage incurred; however, this shall not apply if the "Mall" proves that there was no intent or negligence.

Article 5 (Suspension of Services)

① The "Mall" may temporarily suspend the provision of Services due to maintenance, replacement, or breakdown of information and communications facilities such as computers, or interruption of communications.

② The "Mall" shall compensate users or third parties for damages incurred due to temporary suspension of the Services under paragraph 1; however, this shall not apply if the "Mall" proves that there was no intent or negligence.

③ If the "Mall" is unable to provide Services due to a change of business items, abandonment of business, or merger of businesses, the "Mall" shall notify users by the method set forth in Article 8 and compensate users according to the conditions presented by the "Mall." If the "Mall" has not announced compensation standards, it shall pay users mileage or points, etc. in kind or cash equivalent to the currency value used in the "Mall."

Article 6 (Membership Registration)

① Users may apply for membership by filling out the membership form determined by the "Mall" and expressing their intent to agree to these Terms.

② The "Mall" shall register the applicant as a member unless the applicant falls under any of the following subparagraphs.

1. If the applicant has previously lost membership under Article 7(3), except where three years have passed since the loss and the applicant has obtained the "Mall's" approval for rejoining

2. If there are false statements, omissions, or errors in the registration

3. If registering the applicant as a member is deemed to cause significant technical difficulties for the "Mall"

③ The membership contract is deemed to be established when the "Mall's" acceptance reaches the member.

④ Members shall notify the "Mall" of any changes in the registered information within a reasonable period through methods such as editing member information.

Article 7 (Membership Withdrawal and Loss of Membership)

① Members may request withdrawal at any time, and the "Mall" shall process the withdrawal immediately.

② If a member falls under any of the following reasons, the "Mall" may restrict or suspend the membership.

1. If false information was provided at the time of application

2. If the member fails to pay the price of Goods purchased through the "Mall" or any other debts the member owes in connection with the use of the "Mall" by the due date

3. If the member interferes with the use of the "Mall" by others or steals their information, thereby threatening the electronic commerce order

4. If the member engages in any act prohibited by laws or these Terms or acts against public order and morals

③ If the same act is repeated two or more times after the "Mall" has restricted or suspended membership, or if the cause is not corrected within 30 days, the "Mall" may terminate the membership.

④ If the "Mall" terminates membership, it shall cancel the member registration. In such case, the "Mall" shall notify the member and provide an opportunity to explain for at least 30 days before cancellation.

Article 8 (Notice to Members)

① When the "Mall" gives notice to a member, it may do so by email to the address designated in advance by the member.

② For notices to an unspecified number of members, the "Mall" may substitute individual notice by posting on the "Mall" bulletin board for at least one week. However, matters that have a material impact on the member's own transactions shall be notified individually.

Article 9 (Purchase Application and Consent to Provide Personal Information)

① Users of the "Mall" apply for purchases through the "Mall" using one of the following or similar methods, and the "Mall" shall provide the following contents in an easily understandable manner.

1. Search for and select Goods, etc.

2. Enter recipient's name, address, phone number, email address (or mobile phone number), etc.

3. Confirm the Terms, services with restricted withdrawal rights, and the cost burden such as delivery and installation fees

4. Indicate agreement to these Terms and confirmation or refusal of the items in subparagraph 3 (e.g., mouse click)

5. Apply for purchase of Goods, etc. and agree to the "Mall's" confirmation

6. Choose a payment method

② If the "Mall" needs to provide the purchaser's personal information to a third party, it must inform the purchaser of 1) the recipient of the personal information, 2) the purpose of use by the recipient, 3) the items of personal information provided, and 4) the retention and use period, and obtain consent. (The same applies if the consented items are changed.)

③ If the "Mall" entrusts a third party with the handling of personal information, it must inform the purchaser of 1) the entrusted party and 2) the details of the entrusted work, and obtain consent. (The same applies if the consented items are changed.) However, if it is necessary for contract performance for service provision and relates to convenience for the purchaser, it may be notified through the privacy policy as prescribed in the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., without going through separate notice and consent procedures.

Article 10 (Formation of Contract)

① The "Mall" may reject a purchase application as described in Article 9 if it falls under any of the following subparagraphs. However, if a contract is concluded with a minor, the "Mall" must notify that the minor or legal representative may cancel the contract if the legal representative's consent has not been obtained.

1. If there are false statements, omissions, or errors in the application

2. If a minor purchases Goods or Services prohibited by the Youth Protection Act, such as tobacco or alcohol

3. If accepting the purchase application is deemed to cause significant technical difficulties for the "Mall"

② A contract is deemed to be formed when the "Mall's" acceptance reaches the user in the form of a confirmation of receipt under Article 12(1).

③ The "Mall's" acceptance shall include information on confirmation of the user's purchase application, availability for sale, and correction or cancellation of the purchase application.

Article 11 (Payment Methods)

Payment for Goods or Services purchased from the "Mall" may be made by any available method, and the "Mall" shall not collect any additional fees for the user's payment method.

1. Phone banking, internet banking, mail banking, etc.

2. Prepaid cards, debit cards, credit cards, etc.

3. Online bank transfer

4. Payment by electronic currency

5. Payment upon receipt

6. Payment using points such as mileage granted by the "Mall"

7. Payment using gift certificates contracted with or recognized by the "Mall"

8. Other electronic payment methods

Article 12 (Confirmation of Receipt, Change and Cancellation of Purchase Application)

① The "Mall" shall notify the user of confirmation of receipt when the user applies for purchase.

② If there is any discrepancy in the user's intent after receiving the confirmation of receipt, the user may request changes or cancellation of the purchase application immediately, and the "Mall" shall process such request without delay before delivery. However, if payment has already been made, Article 15 on withdrawal of subscription, etc. shall apply.

Article 13 (Supply of Goods, etc.)

① Unless there is a separate agreement between the "Mall" and the user regarding the timing of supply of Goods, etc., the "Mall" shall take necessary measures such as custom production and packaging so that Goods, etc. can be delivered within 30 days from the date of the user's subscription. However, if the "Mall" has already received all or part of the price, it shall take measures within 21 business days from the date of receipt of the full or partial price. At this time, the "Mall" shall take appropriate measures so that the user can check the supply procedure and progress.

② The "Mall" shall specify the delivery method, the party responsible for delivery costs, and the delivery period for each method for Goods purchased by the user. If the "Mall" exceeds the agreed delivery period, it shall compensate the user for any damages caused thereby, unless the "Mall" proves that it had no intent or negligence.

Article 14 (Refund)

If the "Mall" cannot deliver or provide Goods, etc. due to out-of-stock, etc., it shall notify the user without delay, and if it has received the price in advance, it shall refund the price within 3 business days from the date of receipt or take necessary measures for refund.

Article 15 (Withdrawal of Subscription, etc.)

① A user who has entered into a contract with the "Mall" for the purchase of Goods, etc. may withdraw the subscription within 7 days from the date on which the user receives a written document regarding the contract contents pursuant to Article 13(2) of the Act on Consumer Protection in Electronic Commerce, etc. (or from the date the user receives the Goods or the supply of Goods starts if that date is later). However, if the Act provides otherwise, the Act shall prevail.

② If the user has received the Goods, the user may not return or exchange the Goods in any of the following cases.

1. If the Goods are lost or damaged due to reasons attributable to the user (except where necessary to confirm the contents by damaging packaging)

2. If the value of the Goods has significantly decreased due to the user's use or partial consumption

3. If the value of the Goods has significantly decreased to the extent that resale is difficult due to the passage of time

4. If the packaging of Goods that can be replicated with the same performance has been damaged

③ Notwithstanding subparagraphs 2-2 to 2-4, if the "Mall" did not take measures such as clearly stating in an easily noticeable place that withdrawal is restricted or providing a trial product, the user's withdrawal shall not be restricted.

④ Notwithstanding paragraphs 1 and 2, if the contents of the Goods differ from the labeling/advertising or the contract contents, the user may withdraw within three months of receiving the Goods or within 30 days of knowing or being able to know the fact.

Article 16 (Effects of Withdrawal of Subscription)

① If the "Mall" receives returned Goods, it shall refund the price within 3 business days. If the "Mall" delays the refund, it shall pay delay interest calculated by multiplying the delay period by the interest rate prescribed in Article 21-2 of the Enforcement Decree of the Act on Consumer Protection in Electronic Commerce, etc.

② If the user paid using a credit card or electronic currency, the "Mall" shall request the provider of the payment method to stop or cancel the claim without delay.

③ The user shall bear the cost of returning Goods in cases of withdrawal. The "Mall" shall not charge any penalty or damages. However, if withdrawal is due to the Goods being different from the labeling/advertising or contract contents, the "Mall" shall bear the cost of returning.

④ If the user paid the shipping fee when receiving Goods, the "Mall" shall clearly indicate who bears the cost in case of withdrawal so that the user can easily understand.

Article 17 (Personal Information Protection)

① The "Mall" collects the minimum personal information necessary for providing Services.

② The "Mall" does not collect information in advance required for purchase contract performance at the time of membership registration. However, if identity verification is required under relevant laws before purchase, it may collect minimal specific personal information.

③ When collecting and using personal information, the "Mall" shall notify the user of the purpose and obtain consent.

④ The "Mall" shall not use collected personal information for purposes other than those for which it was collected, and shall notify the user of the purpose and obtain consent when a new purpose arises or when providing to a third party, unless otherwise provided by law.

⑤ If the "Mall" must obtain consent under paragraphs 2 and 3, it shall specify or notify in advance the matters prescribed in Article 22(2) of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., such as the identity of the person responsible for personal information management (affiliation, name, phone number, and contact info), purpose of collection and use, and information on provision to third parties, and the user may withdraw such consent at any time.

⑥ Users may request access to or correction of their personal information at any time, and the "Mall" shall take necessary measures without delay. If a user requests correction, the "Mall" shall not use the personal information until it is corrected.

⑦ The "Mall" shall minimize the number of persons handling personal information and shall be fully responsible for damages arising from loss, theft, leakage, provision to third parties without consent, alteration, etc. of personal information, including credit card and bank account information.

⑧ The "Mall" or a third party receiving personal information shall destroy it without delay once the purpose of collection or provision is achieved.

⑨ The "Mall" shall not pre-select consent for collection/use/provision of personal information, and shall specify in detail any services that may be restricted if consent is refused, and shall not limit or refuse services such as membership registration due to refusal to consent to collection/use/provision of non-essential personal information.

Article 18 (Obligations of the "Mall")

① The "Mall" shall not engage in acts prohibited by law or these Terms or contrary to public order and morals, and shall make its best efforts to provide goods and services continuously and stably.

② The "Mall" shall establish a security system to protect users' personal information (including credit information) so that users can safely use internet services.

③ If the "Mall" causes damage to users by engaging in unfair labeling/advertising under Article 3 of the Act on Fair Labeling and Advertising, it shall be liable for damages.

④ The "Mall" shall not send unsolicited commercial emails.

Article 19 (Obligations Regarding Member ID and Password)

① Except for Article 17, responsibility for management of ID and password lies with the member.

② The member shall not allow a third party to use his/her ID and password.

③ If a member becomes aware that his/her ID and password are stolen or used by a third party, the member shall notify the "Mall" immediately and follow the "Mall's" instructions.

Article 20 (Obligations of Users)

Users shall not engage in the following acts.

1. Registering false information when applying or changing information

2. Theft of others' information

3. Altering information posted on the "Mall"

4. Transmitting or posting information (computer programs, etc.) other than that designated by the "Mall"

5. Infringing intellectual property rights such as copyrights of the "Mall" or third parties

6. Damaging the reputation of the "Mall" or third parties or obstructing their business

7. Disclosing or posting obscene or violent messages, images, sounds, or other information contrary to public order and morals

Article 21 (Relationship between the Linked "Mall" and the Linked "Mall")

① If an upper "Mall" and a lower "Mall" are linked by hyperlink (including text, images, and video), the former is referred to as the linked "Mall" (website) and the latter as the linked "Mall" (website).

② If the linked "Mall" clearly states on its initial screen or at the time of linking via a pop-up that it does not guarantee transactions conducted by the linked "Mall" for goods provided independently by the linked "Mall," it shall not bear warranty responsibility for such transactions.

Article 22 (Ownership of Copyright and Restrictions on Use)

① Copyrights and other intellectual property rights in works created by the "Mall" belong to the "Mall."

② Users shall not reproduce, transmit, publish, distribute, broadcast, or otherwise use for commercial purposes or allow third parties to use any information obtained through the "Mall" for which intellectual property rights belong to the "Mall" without prior consent.

③ If the "Mall" uses copyrights belonging to users under agreement, it shall notify the user.

Article 23 (Dispute Resolution)

① The "Mall" establishes and operates a damage compensation handling organization to reflect legitimate opinions or complaints from users and compensate damages.

② The "Mall" shall give priority to handling complaints and opinions submitted by users; however, if prompt processing is difficult, the "Mall" shall immediately notify the user of the reason and schedule.

③ If a user applies for dispute resolution regarding electronic commerce disputes with the "Mall," the user may follow the mediation of the Fair Trade Commission or a dispute resolution institution commissioned by a city/provincial governor.

Article 24 (Jurisdiction and Governing Law)

① Lawsuits regarding electronic commerce disputes between the "Mall" and users shall be filed in the court with jurisdiction over the user's address at the time of filing, and if there is no address, the court with jurisdiction over the user's residence. If the user's address or residence is unclear or the user resides overseas, the lawsuit shall be filed in the court with jurisdiction under the Civil Procedure Act.

② Korean law shall apply to lawsuits regarding electronic commerce disputes between the "Mall" and users.

Supplementary Provisions (Effective Date) These Terms shall take effect on March 10, 2025.
